Terms of Service

PARTIESThese Terms of Service (“Agreement”) constitute a legally binding contract between Lilxth, an independent digital artist (“Artist”), and the individual or entity purchasing or commissioning artwork (“Client”).2. ACCEPTANCE OF TERMSBy placing an order, submitting payment, or otherwise requesting services, the Client confirms that they:Have read and understood this Agreement in full;Agree to be legally bound by its terms;Are at least 18 years of age, or have authorization from a legal guardian.Failure to comply with these Terms may result in cancellation of services or refusal of future commissions.3. SERVICESThe Artist provides custom digital illustration and graphic services, which may include, but are not limited to:LogosPhoto or character editsChibi illustrationsHeadshotsEmotesHalf-body illustrationsFull-body illustrationsCharacter reference sheetsService descriptions and pricing are provided on the Artist’s official platform. Prices reflect artistic skill, labor, and creative complexity.4. PAYMENT4.1. Full payment is required before the Artist begins work.
4.2. Accepted payment methods include third-party platforms such as Revolut, Steam gifting, and Robux (subject to value limits).
4.3. The Artist is not responsible for third-party processing delays, fees, currency conversion differences, or technical issues.
4.4. Failure to provide payment voids the commission request.5. ADDITIONAL FEESAdditional charges may apply for:Rush or priority deadlinesComplex or fully rendered backgroundsAdditional characters or elementsCommercial usage rightsSuch fees will be communicated prior to final confirmation of the commission.6. REVISIONS6.1. One minor revision is included at no additional charge.
6.2. Further revisions, significant changes, or redraws may incur additional fees based on the extent of modification.
6.3. Requests that alter the original concept after approval may be treated as a new commission.7. TIMELINE7.1. Estimated completion time is typically between one (1) and four (4) weeks.
7.2. Timelines are not guaranteed and may be affected by workload, health, or unforeseen circumstances.
7.3. The Client acknowledges that delays do not constitute breach of contract.8. REFUNDS8.1. Full refunds are issued only if the Artist is unable to complete the commission.
8.2. Partial refunds may be granted if cancellation occurs before substantial work is completed.
8.3. No refunds will be issued once the final artwork has been delivered.9. CLIENT CONDUCTThe Artist reserves the right to terminate or refuse service if the Client engages in:Harassment or abusive behaviorDisrespectful communicationAttempts to obtain unpaid workViolations of these TermsTermination may result in blacklisting without refund if misconduct occurs.10. CONTENT RESTRICTIONSThe Artist does not create:Explicit or NSFW materialIllegal or hateful contentRealistic or hyper-realistic portraitureThe Artist retains sole discretion over accepted subject matter.11. INTELLECTUAL PROPERTY11.1. The Artist retains full copyright ownership of all artwork.
11.2. Clients receive a non-exclusive, non-transferable personal-use license unless otherwise agreed in writing.12. PROHIBITED USESWithout explicit written authorization, the Client may not:Mint artwork as NFTsUse artwork in AI training datasets or machine learning systemsResell, redistribute, or sublicense the artworkRemove the Artist’s watermark or signature13. COMMERCIAL USE13.1. Any use involving monetization, branding, merchandise, or promotional materials requires a commercial license.
13.2. Commercial rights are subject to additional fees and must be agreed upon prior to delivery.14. MODIFICATIONSClients may resize or crop the artwork for formatting purposes only. Alterations, edits, or manipulations of the artwork are prohibited.15. CREDITWhen posting artwork publicly, the Client must credit the Artist as “Lilxth.”16. ARTIST RIGHTSThe Artist reserves the right to:Display commissioned work in portfolios and social mediaDecline commissions for any reasonUpdate pricing or policies with noticePrivate commissions must be requested prior to the start of work.17. COMMUNICATIONPrimary communication methods include official email, website forms, or the Artist’s designated messaging system. Response time is typically 24–48 hours, excluding weekends and holidays.18. LIMITATION OF LIABILITYThe Artist is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the artwork.19. ENTIRE AGREEMENTThis document constitutes the entire agreement between the Artist and Client and supersedes any prior communications or understandings.20. ACKNOWLEDGMENTBy commissioning the Artist, the Client confirms acceptance of these Terms in full.
